This Privacy Policy (“Policy”) describes how Hamer Environmental and its affiliates (“Hamer Environmental”, “we”, “our”, or “us”) treat certain information collected or provided in connection with an end user’s (“you”, “your”, “user”) use of Hamer’s website at www.hamerenvironmental.com as well as any other website, social-media page (e.g., our Instagram and LinkedIn pages), and all services provided by Hamer Environmental in connection with the Site (together, the “Site”). The information provided in this Policy is designed to inform you of what information we collect, why we collect such information, how we use the information we collect, and the choices we offer, including how to access and update information. This Privacy Policy is not a contract and does not create any legal rights.
By accessing or using our Site and/or engaging in our services, you consent to this Privacy Policy, including our collection, use, and disclosure of your Personal Information as described below.

1. SCOPE
For the purposes of this Privacy Policy, “Personal Information” may include your first and last name, your email address, your home or other physical address, including a street name and name of a city or town, your telephone number, any payment or financial information, or any other identifier that permits us to contact a natural human person, like you, and/or any information that we, or our authorized third-party vendors or partners, maintain that could be used to identify you in combination with any of the identifying information described above, including information that identifies, relates, to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, or as may be relevant under applicable law.
This Privacy Policy applies only to Personal Information. It does not cover data we, or our authorized third-party vendors or partners, collect that cannot be used to identify an individual or to pseudonymous data. Nor does it include encoded or anonymized information or aggregated data that we collect or create about a group or category of products, users, or features that does not contain personally identifying information. We reserve the right to collect and share aggregate, encoded, or anonymized information with potential partners or other third parties without restriction.
2. CHANGES
This Policy applies to all relevant information collected by or provided to us or our authorized third-party vendors or partners and/or in connection with the Site as of the Effective Date. When we make any material changes to this Policy, we will update the Effective Date above and may also inform you by email sent to the address we may have for you. We will treat your continued use of the Site following such notice as your acceptance of the changes.
3. COLLECTED INFORMATION
3.1. INFORMATION SUBMITTED TO US
We collect Personal Information you provide to us when you use the Site and/or our services. We also collect Personal Information about you from other consumers, prospective consumers, Site users, and other individuals and entities with whom Hamer Environmental has contact (such as those served by internet-connected devices or household recipients of direct mail to “current resident”). We collect Personal Information in order to improve our services, deliver services, and perform obligations under contracts we have with you, to comply with our own legal obligations, and for other purposes as described below.
For example, we may collect and maintain Personal Information about you to create a personal profile containing purchasing preferences and other information that you voluntarily provide to us if you purchase our services. Examples of the types of information we may collect for this purpose include your first and last name, a valid email address, and geographic location or address. Additionally, if you
request services from us, we may ask you for information such as name, address, telephone number, email address, and credit card number to process your request. We may use your email address to send a confirmation and, if necessary, may use the other information to contact you for help to process the order. You can choose not to provide such Personal Information, in which case you may not be able to request or receive services, or access or use portions of the Site or some of its features.
We may also collect, in instances where you have provided it, information about other individuals, including their email address and Personal Information. If you are sharing information with us about any other individuals, you must obtain their consent.
3.2. INFORMATION COLLECTED AUTOMATICALLY
When you use the Site, we automatically gather certain information from you. This includes usage information, such as information on when, how often, and for how long you use the Site and the content you submit and view. This also may include server log data such as the IP address, time zone, operating system, some of the cookies installed on your device, or the webpage you were visiting before you came to our Site. As described below, we collect this information through a number of means, including server logs, cookies, online tracking mechanisms, and in connection with third parties. We may associate such information with other personally identifiable information we have about you.
3.3. ANALYTICS
We use certain third-party services to assist us in analysis, auditing, research, and reporting regarding the Site and the services we offer. For instance, our web servers may collect “log data.” Log data provides aggregate information about the number of visits to different pages on the Site. We may use log data for troubleshooting purposes and to track which pages people visit in order to improve the Site. Third-party vendors may also collect aggregate log data independently from us.
3.4. COOKIES AND OTHER TECHNOLOGIES
We automatically receive and store certain types of information when you visit the Site through the use of cookies, web beacons, or similar programs to collect the information described above. The Site creates session cookies for each visit in order to facilitate your visit. The session cookie expires at the end of the session.
We occasionally use persistent cookies, which remain on your device for much longer. Cookies do not corrupt or damage your computer or computer files.
We use cookies for authentication, to remember your settings, to keep track of your activity during a visit to the Site, to conduct usability tests, to improve Site performance, and to implement certain features of the Site.

Our business partners also use cookies for the same general purposes identified in this Privacy Policy, including to improve their own marketing, products, or services. Third parties use cookies and other technologies to collect information about your online activities over time and across different websites. Third parties we work with also use other "device-graphing" information in order to make inferences and connections about our customers and potential customers across various devices – such as mobile phones, tablets, and browsers. (These companies may, for instance, make inferences that devices seen at a common IP address are used by common users.) Companies that we share information with use the information we provide to them, often in combination with their existing information, to provide you with more relevant advertising. Please see the "Do Not Track" section below for more information regarding personalized advertisements and your "Do Not Track" options.
Some of the pages on the Site may contain electronic images known as web beacons that allow us to count the number of users who have visited those pages. These collect only limited information such as a cookie number, time and date of a page view, and a description of the page on which the web beacon resides. These web beacons do not carry any personal information and you cannot opt-out or refuse them. However, where they operate with cookies, you can render them ineffective by changing the cookie setting in your browser.
3.5. MARKETING COMMUNICATIONS AND ADVERTISEMENTS; DO NOT TRACK
We use third-party service providers or content to send or augment our marketing emails, texts, or communications. While there are no cookies in the email, when an email recipient clicks on a link to the Site included in the email, a persistent cookie may be placed on the user’s device. If used, this cookie measures the effectiveness of our email marketing efforts, helping us to better understand how our users navigate through the Site, and to enhance user experience. To that end, we may collect a variety of information about how users interact with our marketing efforts, including how many times the email is opened and/or clicked, the browser type used, operating system, user email program, etc. In addition, third parties that assist with our marketing communications may use pixel tags that help us send an email in a format you can read, to allow us to know which communications you act upon, and to better target the content of future communications. We may also use these tags, for example, to track the aggregate number of emails read and whether any of the links in the email were accessed.
Additionally, we may share, exchange, or rent information that may include your name, address, email address, demographic data (such as age, gender, income level, and purchasing profiles), and purchasing behavior with carefully selected third-party organizations including our outside vendors, marketers of products and services potentially of interest to you, and cooperative database services. We may use cooperative databases primarily to identify potential subscribers and customers.
Like many websites, the Site does not currently respond to “do not track” browser headers, but you can limit tracking by taking the steps discussed in the section of this Privacy Policy titled “VIEWING AND AMENDING INFORMATION”.
3.6. LINKS TO SOCIAL MEDIA/THIRD PARTY SITES
The Site may include social media features connected with social networking sites such as Instagram (such sites, “Social Sites”), including a social media “Like” button, and widgets, such as the ShareThis button or interactive mini-programs that run on the Site. These features may collect your IP address, which page you are visiting on the Site, and may set a cookie to enable the feature to function properly. Social Site features and widgets are either hosted by a third party or hosted directly on the Site. Your interactions with these features, including any Personal Information you provide via these features, are governed by the privacy policy of the company providing it.
The Site may include links, or redirect you, to other third-party websites. This Privacy Policy only applies to our Site and services. We do not make any representations about any websites other than our own. Any Personal Information you provide to any linked websites will be subject to the privacy policies of that website. If provided, you should review the privacy policies of any linked websites carefully.
3.7. CHILDREN UNDER 18
Hamer Environmental does not knowingly collect information from minors and the Site and any services we offer are intended for adults over the age of 18. Consistent with applicable law, we do not knowingly collect personal information from minors under the age of thirteen (13) without the consent of their parents or guardians. If we learn that we have inadvertently obtained information in violation of applicable laws prohibiting the collection of information from minors without such consent, upon proper notice, authority, and necessary confirmation of such, we will work to promptly delete it.

We use the Personal Information provided or obtained through the Site or our services to:

As explained above, we process your data to provide you with the services you have requested or purchased from us. We use this information to refine our services to better tailor them to your needs and to communicate with you about other services we offer. Most of the time, we need to process your Personal Information to fulfill an order for services or request for information. Sometimes we have a legitimate interest in processing data to better understand the needs, concerns, and interests of our Site visitors and customers so we can operate optimally as a business. And sometimes, we rely upon your consent, in which case we will keep a record of it and honor your choices.
We generally store Personal Information in the United States as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, as we determine is necessary for business records, and as required under applicable law. However, we may transfer your personal information from the United States to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and operating our business. By providing any information to us, you consent to such transfer, storage, and processing.
We may also combine the information you provide to us over time and we may combine such information with information that is publicly available, collected through cookies and other technologies, and information that we receive from our partners and other third parties. We may use that combined information to better provide you with our services and to better provide you with personalized content, customized content, and advertising.
5. DISCLOSURE OF INFORMATION
We want you to understand when and with whom we may share personal or other information we have collected about you or your activities on our Site. We sometimes share Personal Information with:

• Our service providers and those with whom we’ve contracted in connection with our Site, and/or services, such as marketing agencies, promotional partners, website hosts, and various customer, tech, and operational support

In such cases, we may raise or waive any legal objection or right available to us, in our sole discretion. We will disclose and exchange information as necessary in connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy. We may also share personal or other information we have collected about you or your activities on our Site as you may request or otherwise consent to.

Any third parties to whom we may disclose Personal Information may have their own privacy policies which describe how they use and disclose Personal Information. Those policies will govern the use, handling, and disclosure of your Personal Information once we have shared it with those third parties as described in this Privacy Policy. If you want to learn more about their privacy practices, we encourage you to visit the websites of those third parties. These entities or their servers may be located either inside or outside the United States.
We may share aggregated and non-personal information we collect under any of the above circumstances.
We may combine personal information we collect with additional personal information collected from other sources. We may also share aggregated non-personal information with third parties, including advisors, advertisers, and investors, for the purpose of conducting general business analysis. For example, we may tell our advertisers the number of visitors to our Site and the most popular features or services accessed. This information does not contain any personal information and may be used to develop website content and services that we hope you and other users will find of interest and to target content and advertising. We may also report aggregated, de-identified data relating to activity on the Site to third parties or the general public. We may combine such data with data obtained from third-party sources in order to generate such reports.
In the event of a merger, sale of capital stock or assets, reorganization, restructuring, consolidation, or similar transaction involving Hamer Environmental, the information we possess (including personally identifiable information) shall be transferred as a corporate asset to the acquiring entity, provided that such entity will continue to handle such information in accordance with this Policy.
6. VIEWING AND AMENDING INFORMATION
You can choose not to provide us with certain information, but that may result in you being unable to use certain features of our Site or services we offer because such information may be required in order for you to purchase services; ask a question, or initiate other transactions on our Site.
Please contact us at info@hamerenvironmental.com if you no longer wish to receive communications regarding the Site or our services. Opt-out requests may not be able to be immediately processed, and we may also continue to send you other types of transactional and relationship email communications, such as service announcements, administrative notices, invoices, payment receipts, and surveys, without offering you the opportunity to opt-out of receiving them. You may request that we not share your personal information with third parties for direct marketing purposes by contacting us at info@hamerenvironmental.com. Please also note that opting out of receipt of promotional email communications will only affect future activities or communications from us.
Changes to, or deletion of, any Personal Information do not affect any other information collected by Hamer Environmental, which Hamer Environmental may retain and continue to use or disclose in accordance with this Policy. If we have already provided your Personal Information to a third party before you have changed your preferences or updated your Personal Information with us, you may have to change your preferences directly with that third party.
We reserve the right to verify the identity of any person making a request to opt-out or to delete or modify Personal Information; provided, however, that we will have no liability of any kind resulting from false or erroneous requests or any change or deletion made by us for any reason.
We store Personal Information for only as long as reasonably necessary to fulfill the purposes described above, as we determine is necessary for business records, and as required under applicable law.
7. SECURITY; UPDATES
We take reasonable measures to protect your Personal Information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse.
To mitigate this risk, you should use secure usernames and passwords and carefully protect them from disclosure and implement updated internet security and virus protection on your device(s). If you suspect that your device's security or your information has been compromised or your password accessed or used by an unauthorized third party, immediately change your password and take other security steps as may be necessary or recommended in such circumstances.
If we become aware of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice through the Site if a security breach occurs. We may also send an email to you at the email address you have provided to use in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.
Users should also be aware of how they handle and disclose their Personal Information and should avoid sending personal information through insecure email. We also may update this Privacy Policy from time to time. When we do so, we will post the new Privacy Policy on the Site and your continued use of the Site or services offered by us and online aspects associated therewith is deemed to be acceptance of such updates or changes. We encourage you to check the date of our Privacy Policy when you access and use the Site for any updates or changes.
8. INTERNATIONAL VISITORS
If you are an EU or UK resident, the rights outlined in this section also apply to you.
Under the General Data Protection Regulation (GDPR) or similar laws, we can only use your data for certain reasons where we have a valid legal basis. We will only use (process) your personal data if you have given us consent to do so, it is necessary to fulfill a contract or fulfill our services to you, it is necessary to respond to an inquiry or communication you have sent to us, or it is necessary for a legal obligation.
To deliver services to you, it is necessary for us to transfer your personal data to the United States. Until there is an adequacy decision, we will enter into standard contractual clauses with our service providers when needed to ensure compliance with applicable data protection laws.
Under the GDPR (or similar laws), residents of the European Union (EU) member countries and/or the United Kingdom (UK), have certain additional rights with respect to personal information, including, without limitation, the following:

• the right to rectify your personal information if it is incorrect or incomplete.
• the right to have your personal information erased (“right to be forgotten”) if certain grounds are met.
• the right to withdraw your consent to our processing of your personal information at any time (if our processing is based on consent).
• the right to object to our processing of your personal information (if the processing is based on our legitimate interests) provided that we may retain your personal information for certain compelling purposes such as legal, auditing, accounting, and billing purposes.
• the right to object at any time to our processing of your personal information for direct marketing purposes, including, without limitation, for profiling purposes to the extent that it is related to direct marketing. If you object to processing for direct marketing purposes, we will no longer process your personal information for such purposes.
• the right to receive your personal information from us in a structured, commonly used, and machine-readable format, and the right to transmit your personal information to another controller without hindrance from us (data portability).
The following terms shall also apply to our collection, use, and retention of the personal information of applicable EU and UK residents:
Basis for collection. As set out above, we collect and process personal information for which you have given your express consent at the time of collection. For example, we collect personal information when you elect to receive our newsletters. We also collect and process personal information in order to improve our services, to deliver services and perform obligations under contracts we have with you, and to comply with our own legal obligations.
Sensitive data. We do not collect sensitive data, for example, biometric data, health data, or data revealing racial or ethnic origin, from visitors to our Site.
Onward transfer. Any personal information you have shared publicly with others may continue to be publicly visible on the site.
You also have the right to obtain a copy of the personal information we have about you, although we reserve the right to charge a fee for this depending on the nature and frequency of your request(s) and our cost to provide the information.
If you are located in the European Union or the UK and the GDPR, or a similar law, applies to you, and you are or have been our customer, we may send you marketing communications based on our legitimate interests, subject always to your right to opt-out of such communications. Further, if you are located in the European Union or the UK, and the GDPR, or a similar law, applies to you, we will not share your personal information with a third party for such third party’s marketing purposes, unless you have specifically consented to us doing so.

We may request specific information from you to confirm your identity, and in some circumstances, we may charge a reasonable fee for access to your personal information. We are not obligated to make data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf. Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.
We hope that we can resolve any questions or concerns you may have about this Policy. In the European Union, you have the right to file a complaint with a supervisory authority.
